With all the debate about the way asbestos related disease can be handled in our courts, it is good to get back to basics. Exposure to asbestos fibers causes lung problems and cancer. It can cause death. Anyone who is demolishing buildings that may have contained asbestos, anyone living in a home with asbestos in the building or anyone still working with asbestos is at risk.
With this in mind it will help to keep in mind the difficulties of the tort system when it comes to making claims about how ill a person will become after the asbestos fibers have had chance to do their damage. there is no easy way to predict how ill someone will become in ten years or more. Or how much emotional trauma has been caused to an individual or a group of individuals whose work has exposed them to asbestos fibers. We also cannot take into consideration death from other causes before the asbestos related problems occur. People die every day from automobile accidents as well as gunshot wounds. there is no promise of safety in this life.
How can we deal fairly with those who will suffer from asbestos-related cancers and lung-disease in the future when there is no-one left to sue? What comeback do those who were sued have against those who sued them? What about those who maybe put them out of business who yet they have never ever developed any sign of asbestos-related disease or cancer? Am I going wild here? No I think not. there are millions of people who claim that they will suffer from asbestos-related lung disease who have never had a symptom. how can you prove that they will become ill?
Asbestos is a killing industry.
